hi! i am in the US on a tourist visa and i am scheduled to take the NCLEX and IELTS in august. My agency told me that after passing both exams they would file for my working permit, working visa & immigrant visa. If God permits that i pass both exams and got the results in the last week of August, when should i expect to start working? how does the retogression affect my status?
furthermore, after passing the nclex & ielts, what are the next steps that i should do? please give me a list of the things that i still need to do and how many months or days should i wait for the processing of each step.

PS. by the way, i am included in the unfortunate batch of june 2006 and already took the re-take last june 2007, im still waiting for the results.

Hi garnet 1881, The best thing to is wait for the result of your local board exam first. This will determine whether you will be qualified for an immigrant visa, as the CGFNS requires that you pass the local board exam for your VisaScreen certification. And your VisaScreen certificate is required for applying for an immigrant visa. Passing the NCLEX and forein language exam would qualify you to apply for a non-immigrant working visa or H1-B, even if you don't pass the local board exam. Once you passed all the necessary exams, your agency should be able to take care of the rest. If you get all your results and passed them all before the August 17th deadline for immigrant visa application, then your papers will be in and you just have to wait for your priority date on the processing times. Athough, I see that unlikely to happen, the Dept. of State announced that they will have the immigrant visas for Filipino nurses open again in October. If that is so, then your agency should be able to apply for your immigrant visa in October, and in April of 2008 for your H1-B. Processing times for both take about 6 to 12 months, so you can expect to work sometime late next year or early 2009. It all depends on your case. I can only give you approximation. i hope you will not mind if i will add to this.
based on the postings by the USCIS, schedule A workers (nurses/PT's) have only until July 31 to be filed for the I-140 (immigrant petition for alien worker) since they don't need labor certification anymore. on the other hand all other qualified filers (undergoing labor certifications) have until August 17 to file. i don't mean to burst the bubble as they say but just so everyone will be guided accordingly.
we can always look forward to the October visa bulletin and hope that categories again will be current.

H! I appreciate that your site is very helpful for nurses. I would like to ask if it is really wise to go to Cali US sometime in October this year? I am done with my NCLEX and IELTS exams, I have a VisaScreen certificate; and currently a volunteer nurse in vmmc. What are my realistic options at this time?
